LOUISVILLE, Ky. (WDRB) -- A Louisville-area pool company owner accused of taking money from dozens of clients and never building pools took a plea deal Tuesday in Bullitt County.

Bullitt County Commonwealth's Attorney Bailey Taylor said Tracy Davenport pleaded guilty to two counts of theft by failure to make required disposition of property. He said her two counts of theft by deception were dismissed. 

Last year, Davenport was indicted on charges she took money from two families in Bullitt County but never built their pools. Earlier this year, Davenport pleaded guilty in Floyd County to felony theft and fraud charges. Davenport and her husband, Matt Davenport, own Davenport Extreme Pools and Spas.

According to prosecutors, the couple took $245,000 for pools in Floyd County but never built them. 

As part of the plea deal in Bullitt County, Taylor said Davenport was ordered to pay back around $50,000 in restitution to each family. Taylor said there's no jail time with this plea agreement, but the sentence is five years probated.

Davenport's sentencing is scheduled for Aug. 2, and Taylor said the judge will determine when payments will start and how much she'll have to pay each month.

In a separate case, Davenport is scheduled to begin a jury trial in Clark County on July 16.
