LOUISVILLE, Ky. (WDRB) -- Tracy Davenport was scheduled to appear in court Monday in Bullitt County, her first appearance on charges she and her husband used their business to take people's money for pools they never built.
Davenport was arrested in Louisville last week and is awaiting extradition to Indiana. She was taken into custody Dec. 8 after a second warrant for her arrest was issued last week.
An order to revoke Davenport's bond and issue an arrest warrant was granted in Floyd County on Dec. 5. She also has an arrest warrant out of Clark County.
But Monday was the third time Davenport hasn't shown up for her arraignment in Bullitt County. She was arrested Friday on a warrant out of Clark County, Indiana, but was jailed at Metro Corrections.
She's also charged in southern Indiana for corrupt business influence, theft and fraud. In Bullitt County, she faces charges of theft by deception.
"The judge had essentially said, at this point, we're just going to issue a warrant and that will ensure her appearance," Bailey Taylor, the Bullitt County commonwealth's attorney, said in court Monday. "It looks like the reason she's not appearing is because she's got multiple charges in other states."
Davenport and her husband, Matt, are accused of using Davenport Extreme Pools and Spas to take people's money for pools but never build them.
Court records show a doctor's note was filed in her Clark County case. No other information has been released about that note.
Prosecutors in Indiana said the couple may have taken hundreds of thousands of dollars from several customers. According to court documents, the couple took more than $245,000 from four victims in Floyd County to build pools, dating back to 2021. But they never built anything.
Prior to that, the Davenports turned themselves into the Clark County jail, charged with four counts of theft, four counts of fraud and two counts of corrupt business influence in Clark County — all felony charges.
In an unrelated case, Davenport was arrested last month in Alpha Borough, New Jersey, on drug charges.
According to a news release from James Pfeiffer, the Warren County prosecutor, Davenport was a passenger in a truck driven by Corey B. Young, 38, of Brooks, Kentucky. When New Jersey State Police conducted a commercial vehicle inspection on Route 78, police said they found 179 pounds of marijuana worth an estimated $250,000. They also found a loaded handgun and a large capacity magazine.
Indiana Prosecutors said because of Davenport's new charge while she was out on bond, they think she presents a danger to the community by repeatedly violating the law.
Lawsuits have also been filed against the pool company. One alleges Davenport spent customer money on "lavish vacations to Las Vegas, personal cosmetic surgeries, a six-figure recreational vehicle, and the purchase of an expensive pleasure cruising lake boat."
One lawsuit alleges Davenport collected more than $5 million from about 60 families for swimming pools that were never installed.
Davenport's attorney who represents her in civil cases, Ken Henry, said Davenport is innocent until proven guilty and hasn't been convicted of any of the crimes. He said her civil cases are ongoing and there are extenuating circumstances that people don't realize and some of the customers breached their contracts.
