LOUISVILLE, Ky. (WDRB) -- The owner of a Louisville-area pool company accused of taking money from dozens of clients and never building pools is facing jail time.

Tracy Davenport pleaded guilty in Floyd County last month to felony theft and fraud charges. Davenport and her husband, Matt Davenport, own Davenport Extreme Pools and Spas.

According to prosecutors, the couple took $245,000 for pools in Floyd County but never built them. 

In court Monday, the fraud charges were dropped, but prosecutor Chris Lane said Davenport was officially sentenced to three years in prison for five felony charges including corrupt business influences and four felony theft charges. The four theft charges were one for each victim.   

Civil lawsuits have also been filed against Davenport's company. One alleges Davenport spent customer money on "lavish vacations to Las Vegas, personal cosmetic surgeries and a boat."

She is currently in the Floyd County Jail but is assigned to the Indiana Department of Corrections. Davenport will likely stay in the jail for now, rather than prison, because she is also facing charges in Clark County, Indiana and Bullitt County, Kentucky.

With credit for time served, Davenport could be eligible for release in September, but that's only if she obtains a residence in Indiana because she was also sentenced to one year of home incarceration to be served in the state.

The third year of Davenport's sentence is under supervised probation regardless of her address.  

"She's held accountable here, and I take great pride in that, because she's currently sitting in jail," Lane said.

Davenport is also facing charges in Clark County, Indiana, and has active charges in Bullitt County, Kentucky, as well.
