Attorneys for Gov. Andy Beshear argued against letting the fair board continue to operate with its current members after their win in court last week, saying that would violate the state constitution's 'bedrock separation of powers provisions.'
“I don't know that any of us actually believe we'll be 100% wide-open by state fair,” said Dr. Mark Lynn, the fair board’s chairman. “But if we plan for it, it's easier to make it smaller than bigger.”
House Bill 518 shifts appointing authority of the fair board from Beshear, a Democrat, to Republican Agriculture Commissioner Ryan Quarles and strips the governor's ability to name a chairperson.
The proposal now heads to Gov. Andy Beshear's administration for its review and a decision fair officials hope will come in mid-June.
