LOUISVILLE, Ky. (WDRB) -- A Hardin County couple is facing murder charges after allegedly throwing a man over second-story apartment balcony.

According to court documents, on Nov. 13 a witness told officers she saw Nancy and Shawn Durbin drag a man from the front of the apartment and throw him over a second-story balcony handrail.

When Elizabethtown Police arrived on scene, they found a man with severe blunt force trauma to the face, directly below their apartment.

Nancy Durbin denied any involvement during an interview with Elizabethtown police.

Police said it was an 11-foot-6-inch fall to the concrete pad from the balcony.

The victim, identified by officials as 62-year-old Bobby Pennington, was unresponsive and taken to the hospital in critical condition where he later died.

The Durbins were indicted on Nov. 20 for murder and Shawn Durbin is facing additional charges of assault on a police officer and resisting arrest.

Each is being held on a $500,000 bond and are scheduled to appear in court Dec. 9.
