LOUISVILLE, Ky. (WDRB) -- A Louisville man charged after his 4-year-old son accidentally shot himself with an unattended firearm faced a judge Wednesday. 

Louisville Metro Police officers arrested 23-year-old Jacob Mosley on Feb. 18. Earlier that day, the boy was brought to UofL Health — Medical Center Southwest after he shot himself in the arm at a residence on Mango Court near West Pages Lane and Greenwood Avenue.

The child was transferred to Norton Children's Hospital in downtown Louisville for further treatment, but his injuries were not considered life-threatening, according to police. 

Mosley told investigators he left the gun in a nightstand while he took a shower before he heard the gun go off. Police said the child told them he found the gun on the bed.

During his arraignment, the judge set a $25,000 surety bond after Mosley's attorney requested the cash bond be lowered, noting that the child was not seriously injured and has already been released from the hospital. The attorney also stated that Mosely's family, including the child's mother, is behind him and believe it was "a tragic accident."

The judge agreed to a surety bond instead of full cash, but had this to say: "There has been an epidemic in this community of this allegation — and it is an allegation. You are presumed innocent, sir."

If Mosley posts bond, he must remain under house arrest. The judge also agreed to a work release program so Mosley can continue working. He was also ordered not to possess firearms or have any contact with the child. His next court date is scheduled for Feb. 27.
