LOUISVILLE, Ky. (WDRB) — One of the men set to be sentenced next month in the fatal shooting of Tyree Smith at a Louisville bus stop in 2021 appeared in court Thursday on charges of having drugs in jail.
Demaurion Moore appeared for a pretrial conference in the separate drug case. He pleaded not guilty in June to several charges, including promoting contraband, possession of a controlled substance and trafficking in a controlled substance
According to court documents, Metro Corrections officers searched Moore's cell June 12 while he was in court for the trial in Smith's death. An officer found "two bundles of Suboxone strips wrapped in clear plastic," containing a total of 40 Suboxone strips.
In June, a jury convicted Mekhi Cable and Demaurion Moore of murder, attempted murder, two counts of fourth-degree assault, three counts of wanton endangerment, receiving stolen property and possession of a handgun by a minor.
The two men were convicted of murdering Smith, an Eastern High School student, in a drive-by shooting Sept. 22, 2021, at West Chestnut and Dr. W.J. Hodge streets. Moore and Cable were 15 at the time of the shooting. Both were indicted in July 2022 for Smith's death and Duncan's death.
Two other children, a 13-year-old boy and a 14-year-old girl, were also at the bus stop and survived after being shot. Police said Smith was not the intended target.
In court Wednesday, Judge Tracy Davis sentenced Cable to 60 years in prison for Smith's death. The sentence will run concurrently with a 10-year sentence for the death of his 15-year-old cousin, Cortez Duncan.
Cable cut a plea deal for manslaughter in Duncan's death. Duncan was shot and killed on Thanksgiving 2021, two months after Smith was killed.
Moore's sentencing, however, is scheduled to happen in September. He took a sentencing deal after his conviction for 35 years in prison and will get credit for time served, agreeing to not seek probation or shock probation. Cable was also offered the deal but did not accept, leaving his fate up to the jury and the judge.
Moore will be formally sentenced by Judge Davis Sept. 10 at 1:30 p.m.
