LOUISVILLE, Ky. (WDRB) -- The trial is expected to start Monday for a Louisville man accused of killing another man inside an Okolona Olive Garden four years ago.
The trial for Devone Briggs has been postponed several times, but was set to start Dec. 4.
Briggs is accused of shooting and killing Jose Munoz at the Olive Garden restaurant on Outer Loop in February 2019.Â
Friends said Munoz was trying to stop a fight after Briggs pushed a small child that bumped into him.
Briggs was arrested and charged with murder and wanton endangerment. He was indicted in April 2019, but is out of jail after paying a $70,000 cash bond.
He argues he's immune from prosecution because he was acting in self defense.Â
