LOUISVILLE, Ky. (WDRB) — Prosecutors are pushing back against an effort to dismiss the murder indictment against a former Kentucky sheriff accused of killing a judge.
Shawn “Mickey” Stines, the former Letcher County sheriff, is charged with murder in the death of Letcher County Judge Kevin Mullins. The shooting happened last fall, shortly after Stines was seen on surveillance video entering the judge’s chambers.
Police said Stines shot and killed Mullins just minutes after that encounter. He pleaded not guilty and later resigned from his position as sheriff.
Now, Stines’ attorney is asking a judge to throw out the indictment, claiming there were problems with how the case was presented to the grand jury.
But prosecutors argue the indictment is valid and backed by sufficient evidence. They said the case should proceed to trial.
A judge has not yet ruled on the motion to dismiss.
