LOUISVILLE, Ky. (WDRB) -- As Brooks Houck waits in jail on a $10 million bond for the murder of Crystal Rogers, his brother, Nick Houck, is being investigated for the murder of her father, Tommy Ballard.

The special prosecutor in the Rogers case dropped the bombshell during Brooks Houck's arraignment in court Thursday afternoon.

"We are waiting for testing to come back from the firearm we believe was used to murder Tommy Ballard," Prosecutor Shane Young told a Nelson County judge. "The firearm that we purchased from Nicholas Houck, who was using a fake name when he sold the rifle."

Tommy Ballard was shot in the chest and killed on Nov. 19, 2016. It happened right as he was about to go hunting on family property in Nelson County with his young grandson. While police initially called his death a hunting accident, the FBI has since ruled it a homicide.

Brooks Houck was arrested last week and charged with Rogers' murder. Shortly after the mother of five disappeared in July 2015, his brother Nick Houck was suspended in September 2015 and fired in October 2015 from the Bardstown Police Department for interfering with the investigation. 

WDRB News has been digging deeper through old police interviews with Nick Houck. In one of them, he explodes when an investigator told him he failed a lie detector test surrounding Rogers' disappearance.

Nick Houck: "Because you're telling me I'm lying, and I know I'm not. I know the truth, you know? And I've been 100% honest."

Examiner: "You do know the truth."

Nick Houck: "With you, the grand jury, and everybody else I've spoken with."

Examiner: "No you haven't. Here's what I'm getting, you just said ..."

Nick Houck: "Yes I have."

Examiner: "No you haven't."

Nick Houck: "I most definitely have. And if you don't want to believe it, that's your issue, it's not mine."

Examiner: "It's not just me, I showed you."

Nick Houck: "Dude, I don't give a G**d**n what your f******g computer said." 

Just before the heated exchange, Nick Houck sat calmly in his unbuttoned Bardstown police uniform as he's told he did not pass a lie detector test. 

Some of the questions in that test included: Do you know where Crystal is right now? Are you hiding any information about what happened to Crystal?

Examiner: "You didn't tell me the truth on both of those questions."

Examiner: "And it's no longer a matter of wondering, 'do you know anything about what happened?' We're past that now."

Examiner: "I'm no longer asking you if you know. You do." 

Nick Houck sits in silence. The official then opens his computer to show him the results of his polygraph.

"Deception indicated, 100%," the examiner said.

The examiner also asked Nick Houck about the phone call he made to Brooks Houck as he was being questioned by a detective.

"I know you've told me innocent people have gotten jammed up, but if you're telling me to leave, I'll get up and leave," Brooks Houck said said to his brother on the phone.

The examiner also asked Nick Houck, as a police officer, why he wasn't more involved with helping find Rogers.

Nick Houck: "Listen, they come up with all these lies about, well, there's bodily fluid in your car. There's blood, there's no way in hell there is any blood in that car."

Nick Houck: "I'm just telling you. I didn't do it. I don't know nothing about it. I don't know anything about it. My brother and I can tell you, I know him well enough, he didn't do it."

Examiner: "You ask him 'What can I do?'"

Nick Houck: "There's nothing to do, ya know?"

Examiner: "So she's just gone?"

Nick Houck: "I mean hopefully, like I said, she'll show up any minute. And if not, obviously you guys are going to find her at some point. Find out how she was killed. Is there evidence under her fingernails, all this stuff, and it's not going to point toward him or me."

Examiner: "Who would it point to?"

Nick Houck: "Now how the hell would I know that?"

Examiner: "That's why I'm asking you." 

Nick Houck's interview happened shortly after Rogers disappeared. At this point, he is not facing any charges.
