LOUISVILLE, Ky. (WDRB) -- The family of the man shot in a Louisville Waffle house on New Year's wants justice.
Louisville Metro Police spokesman Aaron Ellis said it happened Monday just before 12:30 p.m. in the 10500 block of Dixie Highway, near Ashby Lane. Officers arrived on scene to find a man inside the restaurant who'd been shot.
Jordan Miller, the daughter of the man shot, said he fell right in front of her. She went with her father, William Miller, to grab breakfast for the family at Waffle House on New Year's Day.
"We hopped into his truck and we drove to Waffle House," Jordan Miller said. "My dad saw him. You know, he made him a promise. Whenever he put his hands on my sister, he was like, he was going to beat him up. That's what was going to happen. It's his daughter."

"We walked in, my dad hit him like two or three times," she said. "And then he (Mack) just went straight for his pistol, pulled it out. He shot my dad in his chest, and I turned around, he was trying to like protect me and he shot him twice in his back."
Court documents show that Mack was arrested for violating an EPO but hasn't been charged with the shooting. He was arraigned on Tuesday. He was released on personal recognizance and there was no bond.
"It wasn't self defense. It was ego," Jordan Miller said.
According to court records, Mack has previous assault charges and domestic violence charges.
"He got out the very next day and actually last night our house caught fire or garage did and we don't know for sure if he was connected to the incident or not," Jordan Miller said. "But if he was, this is another time that the justice system has failed my dad."
The cause of the fire is still under investigation.
Jordan Miller helped save her dad after learning how to stop the bleed at Butler Traditional High School. He's now at UofL Health in the ICU.
"The justice system has completely failed us by letting him out," Carrie Miller, wife of William Miller, said. "I won't stop until my husband gets justice that I promise."
Mack's pretrial conference is planned for Jan. 10.
